Higgins Benjamin partner Ken Gumbiner, along with associate Mandy Castle, represented Racing Optics, Inc. in a patent infringement lawsuit brought by Reaux Medical Industries, Inc. (RMI). Racing Optics is one of the world’s leading manufacturers of laminated tearoffs for use with, for example, racing helmets and NASCAR windsheilds. RMI brought suit against Racing Optics and co-defendant Stryker Corporation for allegedly infringing RMI’s patent for a process for making surgical eye protectors. On May 3, 2012, after a ten (10) day jury trial, the jury in the Northern District of Texas found that Racing Optics did not infringe RMI’s patent and further found that RMI’s patent was invalid but for one claim. In December 2012, the trial judge ruled on several post-trial motions which did not alter the jury’s verdict.
